In December, I appeared with my client in Alpharetta Municipal Court.  He had been charged with probation violation.

Georgia code 42-8-38, provides for arrest of a probationer for violation of the terms of probation.

A probationer, accused of a violation of terms, may be arrested without a warrant and returned to the court granting the probation.

The probationer is entitled to a hearing, and at that time the court may revoke, modify, or continue the probation.

In this particular case, after lengthy negotiation with the court, I was able to get my client’s charge of probation violation dismissed.

This means that my client will not return to jail and can continue to work at his job which is necessary to support his family.
