The DS 1205 permit allows you 30 days of driving privileges; so many people believe that is how long they have to respond. However, this is not true. If you were tested over the legal limit or refused a chemical test, you have only ten business days to request a Georgia administrative license suspension hearing, or your license will be suspended on the 31st day following your arrest. 

Sadly, many people do not understand Georgia DUI law, or how it affects them. This results in license suspensions that never had to happen. Here are a few things you need to know:

  • In 2010, the Georgia Legislature enacted House Bill 1055, which requires drivers arrested for DUI and issued a DS 1205 to pay a fee of $150 that must accompany any letter you send requesting an appeal hearing. 
  • In your request, you must include your full name, address, driver’s license number, birthdate, phone number, names and contact information for all witnesses, a statement explaining what you are asking for, and any conditions you wish to argue. 
  • If this request is late, your license will definitely be suspended. Period. 
  • Including an attorney’s name and contact information is the most effective tool you can have in your letter.
