The Georgia DUI law is written broadly enough that law enforcement officers can arrest someone for driving under the influence of a variety of substances that can impair judgment and the ability to operate a vehicle safely. But even though one law applies, that doesn’t mean everyone who is convicted gets treated the same.

When you are charged with a DUI in Georgia, there are different consequences for different substances. Alcohol, of course, is the most common intoxicant for Georgia DUI arrests. If you are charged with a DUI for using alcohol, you are looking at possible jail time, license suspension, and possible community service. However, if you are charged with a DUI for the use of drugs there are different consequences depending on the drugs you have in your possession.

Marijuana and Prescription Drugs

If you are caught with marijuana or prescription drugs in your vehicle, you are looking at a $1,000 fine and up to 12 months of community service. Also, the prosecutor must prove that the drug caused you to be impaired for your case to be considered under Georgia’s DUI statute.

Illegal Narcotics

Illegal drugs such as heroin or cocaine lead to harsher sentences after conviction. Penalties include:

  • A fine that may be assessed in any amount, subject to the court’s descretion.
  • A prison term of two to fifteen years.
  • License suspension for 180 days.

Because these drugs may never be possessed legally, the prosecutor does not have to prove impairment. As long as they are in your system, you can be charged with a DUI.
