Almost everyone agrees—no one should drink and then get behind the wheel and drive. It’s in the news every day. Horrible accidents, injuries, and deaths occur when intoxicated people insist on driving after a bout of heavy drinking. When the results of their blood alcohol tests come in well over the Georgia limit of .08%, the chances of a conviction are pretty good.

However, some drivers pulled over for driving under the influence (DUI) are not legally intoxicated and their driving is not a danger to others. Do you question your arrest, even though you were given a blood alcohol test? Maybe you should. There are some reasons your test results could be inaccurate:

  • Some police crime labs do not allow for a margin of error—even though there is no such thing as a completely accurate test.
  • People who take certain prescription medications, diabetics, those with high blood ketones, or those who have been taking some cough medications can register elevated blood alcohol content (BAC).
  • Procedures for testing blood vary from lab to lab. Sometimes blood samples are left sitting around too long, resulting in much higher readings.

Never assume that your blood alcohol test cannot be challenged. As a northern Georgia DUI defense law firm, we know that not everything is as it appears.
