My client, who is under 21 years of age, was charged with driving his vehicle 83 mph in a 55 mph zone. Georgia code 40-6-181 establishes that a person convicted of driving 24 to 33 mph over the posted limit shall have four points added to his Georgia department of drivers record This conviction is considered a super speeder conviction and an additional $200 fine must be paid to the state of Georgia. Because my client is less than 21 years of age, if convicted of this speeding charge, he would have his drivers license suspended. After considerable negotiation with the court prosecutor, I was able to get the court to agree to reduce my client’s speed from 83 mph to 69 mph. This is 14 mph over the posted limit and would not suspend my client’s drivers license. My client was given two months to complete a drivers course, and return without attorney, and present to the court the alive at 25 certificate. He will then need to pay court fines of $308.75. Their is no super speeder fine because of the speed reduction I negotiated for him.
