A stop sign violation in Alpharetta, Georgia that led to an arrest for possession.

I am presently defending a young man who's vehicle was stopped because of a stop sign violation. Because of the stop, the law-enforcement officer placed my client under arrest for possession of less than 1 ounce.

The issue in this case is not, did client have less than 1 ounce of marijuana, but was the vehicle stop by the law enforcement officer, a legal stop.

The laws of the state of Georgia require that a vehicle must come to a complete stop at a stop sign, or traffic control light. A complete stop is defined as when all of the vehicle wheels stop rolling forward. This is identified by when the weight of the vehicle settles back down on the rear axle of the vehicle.

When driving your vehicle, always check to be sure that you have the proper registration and insurance card with you. Also be sure you understand and obey all of the Georgia traffic laws.
