A probationer, accused of a violation of terms, may be arrested without a warrant and returned to the court granting the probation. The probationer is entitled to a hearing, and at that time the court may revoke, modify, or continue the probation. Fighting client’s obstruction and striking an officer charge. On Wednesday, October 3, 2018, I accompanied my client to the Fayette County superior court. My client was charged with obstruction and striking an officer, with felony obstruction for head-butting an officer, and also for possession of methamphetamine. I entered a plea for him of obstruction or hindering a law-enforcement officer, Georgia code 16-10-24. The penalty for violating 16-10-24 is $1000 fine and up to one year in jail or both. This being a misdemeanor charge is a significant reduction from the penalty of felony obstruction. My client was unable to enter a plea as a first offender because he had previously had a first offender status revoked. This plea deal resulted in a three-year term of straight probation (no prison time),Fighting client’s obstruction and striking an officer charge. Fighting client’s probation violation in Alpharetta, GA. On Thursday, November 9, 2017, I appeared in Alpharetta Municipal Court along with my client. My client had been charged with probation violation because of a dirty drug screen. My client and I knew prior to appearing in court, that because the dirty drug screen, some jail time would be required. However, based on my argument to the judge, I got the court to agree to one weekend in jail for my client, rather than the 10 days in jail sought by the probation officer. Getting client's probation violation dismissed in Alpharetta, GA. Today, I received a call from a potential client who hired me to fight his probation violation charge in Alpharetta, and a diffrent charge in Roswell. This particular client received a probated sentence for violating Georgia's controlled substance act in Alpharetta, Georgia. He was stopped recently for speeding in Roswell and, he was arrested for marijuana possession. My client who is now back in jail has two problems. First, he violated his original probation, and secondly, he has a new charge of misdemeanor marijuana possession of less than 1 ounce. Each of these two items will be addressed separately. One in Sandy Springs and the other in Alpharetta. This particular type of problem requires an experienced probation violation defense attorney to get the best results. I am hopeful that I will be able to negotiate a settlement, in both courts, that will be beneficial to my client.
