Getting my client’s charge of battery dismissed in Fulton: In December, I appeared in Fulton County Magistrate Court to defend my client charged with simple battery. Georgia code 16-5-23 describes battery as making physical contact of an insulting or provoking nature with the intention of causing physical harm to another person. Simple battery is a criminal misdemeanor, and it can carry penalties of up to one year in prison and fines reaching $1000, including probation and restitution to the victim. Getting client’s DUI reduced in Gwinnett County: In November, I appeared with my client in Gwinnett Recorders Court. I was there to defend him against a DUI, driving less safe charge. Georgia code 40-6-391 states that no one shall drive or be in physical control of a moving vehicle while under the influence of alcohol to the extent that it is less safe for that person to drive. A person convicted of DUI for the first offense in the state of Georgia may have to spend at least 2 days in jail. A fine of not less than $390 and no more than $1000 plus penalties must be paid. There will be a summary probation period of 3 to 5 years. A DUI conviction will remain on your record for 10 years. After considerable negotiation with the prosecutor, I got the court to agree to reduce my client’s charge to reckless driving. My client will not have a DUI conviction on his record. Fighting client's following to close charge in Alparetta City Court: In December, I appeared in Alpharetta City Court to defend my client against the charge of following too closely. Georgia code 40-6-49 requires that any driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent having regard for the speed of such vehicle and the traffic on the highway and the condition of the highway. If convicted of following too closely, that person would be guilty of a criminal misdemeanor, and must pay a fine and court costs, and have three points added to the Georgia drivers record. December: In John’s Creek Court defending client's improper turn. In December, I appeared in Johns Creek City Court to defend my client who was charged with improper turn, driving in the median, and driving on the wrong side of the roadway. Georgia code 40-6-123 covers improper turn. It states that no person shall turn a vehicle into an intersection unless the vehicle is in the proper position upon roadway. Georgia code 40-6-126 provides that if a highway has a central lane in which traffic may enter from any direction, no vehicle shall be driven into such central lane except for the purpose of making a left turn. Georgia code 40 – 6–40 requires vehicles to drive on the right side of the roadway. Conviction of any of the above Georgia codes will add three points to their Georgia drivers record. In this particular case in Johns Creek City Court, I was able to convince the prosecutor to dismiss all of my client’s charges. Striking a pedestrian in the crosswalk Fighting client’s striking pedestrian charge in Sandy Springs Court In September, I appeared with my client in Sandy Springs Municipal Court. He had been charged with striking a pedestrian. Georgia code 40 – 6–91 describes the driver’s obligation to stop for a pedestrian in a crosswalk. Georgia code 40 – 6–93 covers failure to exercise due care near pedestrians. Georgia code 40 – 6–94 covers failure to yield to a blind pedestrian. In all three cases, the driver of a vehicle is obligated to stop for any pedestrian in a crosswalk. Anyone convicted of any of these three offenses shall be subject to a fine, and have three points added to their drivers license record. In this particular case, after lengthy negotiation with the prosecutor, I was able to get the prosecutor to agree to dismiss the charge. My client will be required to attend traffic school, a defensive driving class, and show the court that his insurance company has settled any claim by the pedestrian. Friday, April 12, 2019 at Forsyth County Court: On Friday, April 12, 2019, I appeared with my client in Forsyth County Court. After speaking with the court prosecutor, I got him to allow my client to plead NOLO. My client received a certified court release letter from Forsyth County Court to the Georgia Department of driver services. My client then went directly to the Georgia Department of Driver Services to file this letter. Getting client’s reckless driving charge reduced in Alpharetta. Wednesday, February 20, 2019, at 3:00 PM: I appeared with my client in Alpharetta Municipal Court. He was charged with reckless driving and too fast for conditions. Apparently, my client had been revving his engine at a red light and accelerated too fast for conditions. After much negotiation with the prosecutor, I got to court to agree to reduce the reckless driving charge to a basic rules violation, if my client performs 25 hours of community service, completes a defensive driving course, and pays a court fine. Got client’s speeding ticket reduced in Alpharetta. On Wednesday, February 20, 2019, I appeared with my client in Alpharetta Municipal Court. My client had received a speeding ticket for going 68 mph in a 45 mph zone. Georgia code 40–6–181 requires, that anyone convicted of speeding 19 to 23 mph over the limit will have three points added to their record at the Georgia Department of driver’s services. Following negotiation with the prosecutor, I was able to get my client’s speed reduced to 59 mph, which is 14 mph over the limit. At 14 mph over the limit this becomes a non-reportable incident to the Georgia Department of driver services.
